Terms of Service

Welcome to Pebble.

These Terms of Service ("Terms") govern your access to and use of the Pebble mobile application, website, and related services (collectively, the "Service").

Pebble is operated by James Pursell, based in Georgia, United States ("Pebble," "we," "us," or "our").

By creating an account or using Pebble, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

1. About Pebble

Pebble is a relationship app designed around a simple daily ritual: two people can each ask for one small thing that would help them feel loved, appreciated, or connected that day.

Pebble provides tools that allow two people to communicate these requests, respond to them, and build a shared history through their Nest.

Pebble is a communication and relationship tool. We do not guarantee any particular relationship outcome or that another person will respond to, accept, or complete a Pebble.

2. Eligibility

You must be at least 18 years old to create an account or use Pebble.

By using the Service, you represent that:

• You are at least 18 years old;
• You have the legal capacity to agree to these Terms; and
• Your use of Pebble does not violate applicable law.

Pebble is not intended for individuals under 18.

3. Your Account

Pebble uses Sign in with Apple for account authentication.

You are responsible for maintaining control over your Apple account and any device you use to access Pebble.

You agree not to:

• Access another person's account without authorization;
• Impersonate another person;
• Attempt to bypass Pebble's authentication or security systems; or
• Use another person's account to access the Service.

You are responsible for activity performed through your account.

4. Nests and Partners

Pebble is designed to connect two users through a shared Nest.

By joining a Nest, you understand that certain information you create through Pebble is intentionally shared with the other person in that Nest.

This may include:

• Pebble requests;
• Whether a Pebble has been picked up or completed;
• Thank-you messages;
• Shared Nest history; and
• Other information intended to be part of the shared Pebble experience.

You should only create or join a Nest with someone you trust.

Pebble does not control the relationship between Nest members and is not responsible for how another person interprets, responds to, or acts upon information shared through the Service.

5. Pebbles Are Requests, Not Obligations

Pebbles are intended to communicate small actions that could help another person feel loved, appreciated, supported, or connected.

A Pebble is a request, not an obligation.

Using Pebble does not create a contract, duty, debt, or other legal obligation between Nest members.

Neither Pebble nor James Pursell guarantees that another person will accept, perform, complete, or respond to a Pebble.

Pebble relies on trust between users. Completion of a Pebble is generally reported by the person performing the action and is not independently verified by Pebble.

6. User Content

You may submit content through Pebble, including Pebble requests and thank-you messages ("User Content").

You retain ownership of the content you create.

By submitting User Content, you grant Pebble a limited, non-exclusive license to host, store, process, transmit, and display that content only as reasonably necessary to operate and provide the Service.

This license does not give Pebble ownership of your User Content.

You are responsible for the User Content you submit and for ensuring that you have the right to submit it.

7. Acceptable Use

You agree not to use Pebble to:

• Engage in illegal activity;
• Threaten, harass, stalk, intimidate, or abuse another person;
• Encourage violence or unlawful conduct;
• Exploit or endanger another person;
• Submit sexual or exploitative content involving minors;
• Impersonate another person or misrepresent your identity;
• Attempt to gain unauthorized access to accounts, systems, databases, or networks;
• Interfere with or disrupt the operation or security of Pebble;
• Introduce malware, malicious code, or other harmful technology;
• Scrape, crawl, reverse engineer, or systematically extract information from the Service except where such restrictions are prohibited by applicable law;
• Use Pebble for spam, fraud, scams, or deceptive activity; or
• Use the Service in a way that violates applicable law or the rights of another person.

We may suspend or terminate access to Pebble when we reasonably believe an account is being used in violation of these Terms or presents a risk to users or the Service.

8. Relationship and Personal Disputes

Pebble provides communication tools. We are not a counselor, therapist, medical provider, legal adviser, mediator, or relationship professional.

Pebble does not supervise relationships or determine whether a person's behavior within a relationship is appropriate.

You and your Nest partner are responsible for your own decisions, communications, actions, and relationship.

To the extent permitted by applicable law, Pebble and James Pursell are not responsible for disagreements, disputes, breakups, emotional distress, losses, or other relationship outcomes arising between users.

If you believe you are in immediate danger, contact appropriate local emergency services rather than relying on Pebble.

9. Subscriptions

Pebble may offer premium features through automatically renewing subscriptions.

Available subscription options may include monthly and annual plans.

Subscriptions are purchased through Apple's App Store and may be managed using RevenueCat as part of Pebble's subscription infrastructure.

Automatic Renewal

Subscriptions automatically renew unless canceled in accordance with Apple's subscription policies and within the time required by Apple before the next renewal.

Your Apple ID account will be charged according to the price and billing period presented to you when you purchase the subscription.

You can manage or cancel your subscription through your Apple account's subscription settings.

Deleting Pebble or deleting your Pebble account does not necessarily cancel an active App Store subscription. You should separately manage or cancel your subscription through Apple.

One Subscription, One Nest

Pebble may allow a single active subscription to provide premium access to both members of a Nest.

Only one member of the Nest may need an active subscription for the Nest to receive premium access.

This does not transfer ownership of the subscription to the other Nest member. The person who purchased the subscription remains responsible for managing it through their Apple account.

If the qualifying subscription expires or is canceled, premium access for the Nest may end.

10. Pricing

Subscription prices are displayed before purchase and may vary by country, currency, subscription period, promotions, taxes, or changes made through the App Store.

We may change the price of subscriptions in the future subject to Apple's requirements and applicable law.

Any required notice or consent for subscription price changes will be handled in accordance with applicable App Store requirements.

11. Refunds

Purchases made through Pebble are processed by Apple's App Store.

Refund requests are therefore generally subject to Apple's refund policies and procedures.

Pebble and James Pursell do not directly process your payment card and generally cannot independently issue refunds for transactions processed by Apple.

Nothing in these Terms limits any refund or consumer rights that you may have under applicable law.

12. Account Deletion

You may delete your Pebble account from within the app.

Account deletion may permanently remove information associated with your account.

Because a Nest is shared between two people, deleting an account may also affect information associated with the shared Nest or how that information is displayed to the remaining user.

Account deletion is intended to delete associated Pebble data immediately, subject to information that may need to be retained as required by law or temporarily maintained by infrastructure providers through routine backup, security, or fraud-prevention processes.

Deleting your account does not necessarily cancel an App Store subscription. Subscription management is handled separately through Apple.

13. Privacy

Your privacy is important to us.

Our collection and use of personal information is described in our Privacy Policy, available through Pebble and at our website:

By using Pebble, you acknowledge that you have had the opportunity to review our Privacy Policy.

14. Notifications

Pebble may send push notifications relating to activity within your Nest.

You may disable push notifications at any time through your device's iOS settings.

Disabling notifications does not prevent you from using other available portions of Pebble.

15. Intellectual Property

Pebble, including its software, design, branding, graphics, logos, interface, and other materials provided by us, is owned by or licensed to James Pursell and is protected by applicable intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, and revocable right to use Pebble for its intended purpose.

These Terms do not transfer ownership of Pebble or its intellectual property to you.

Your User Content remains yours as described in Section 6.

16. Service Availability

We work to keep Pebble available and reliable, but we cannot guarantee that the Service will always be available, uninterrupted, secure, or error-free.

Pebble may occasionally be unavailable because of maintenance, technical problems, third-party service interruptions, updates, or circumstances outside our control.

We may add, change, suspend, or discontinue features as Pebble evolves.

17. Third-Party Services

Pebble relies on third-party services to provide certain functionality, including services provided by Apple, Supabase, RevenueCat, and PostHog.

Your use of certain features may also be subject to the terms or policies of those providers.

We are not responsible for outages, changes, or other circumstances caused by third-party services that are outside our reasonable control.

18. Termination

You may stop using Pebble at any time and may delete your account through the app.

We may suspend or terminate your access to the Service if we reasonably believe that you:

• Materially violated these Terms;
• Used Pebble for illegal, abusive, fraudulent, or harmful activity;
• Attempted to compromise the security or operation of the Service; or
• Created a substantial risk to Pebble, its users, or third parties.

Where appropriate, we may provide notice before termination, but we may act immediately when reasonably necessary to protect users, the Service, or comply with law.

19. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Pebble is provided "as is" and "as available."

We do not guarantee that Pebble will always operate without interruption, errors, data loss, or security vulnerabilities.

We also do not guarantee any particular emotional, personal, or relationship outcome from using Pebble.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of Liability

To the maximum extent permitted by applicable law, James Pursell and Pebble will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Service.

This includes, where permitted by law, losses arising from relationship disputes, loss of data, service interruptions, unauthorized access, or reliance on communications made through Pebble.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless James Pursell and Pebble from claims, damages, liabilities, and reasonable expenses arising from:

• Your unlawful use of the Service;
• Your material violation of these Terms;
• User Content that infringes another person's rights; or
• Your intentional misuse of Pebble.

This provision does not apply where prohibited by applicable law.

22. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles.

Nothing in this section prevents you from exercising consumer rights or protections that cannot legally be waived under the laws applicable to you.

23. Changes to These Terms

We may update these Terms as Pebble evolves.

If we make material changes, we may provide notice through the app, our website, or another reasonable method.

The effective date at the top of these Terms indicates when the current version became effective.

Your continued use of Pebble after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

If you do not agree with updated Terms, you should stop using Pebble and may delete your account.

24. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

25. Entire Agreement

These Terms, together with the Pebble Privacy Policy and any additional terms presented when purchasing a subscription or using a particular feature, constitute the agreement between you and Pebble regarding your use of the Service.
